These Terms & Conditions ("Terms") apply to your use of our website and your purchase or use of our publishing, writing, editing, design, marketing and related services.

When you visit our website, submit an inquiry, accept a proposal or invoice, make a payment, or otherwise engage Heritage Crest Publishing for services, you acknowledge that you have read, understood and agreed to these Terms, and any applicable service agreement, proposal, invoice or other written terms provided for your project.

If you do not agree to these terms, please do not access our website or purchase or use our services.

You should check these terms from time to time as we may change them from time to time.

1. OUR SERVICES

Heritage Crest Publishing provides professional publishing and author-support services, which may include:

• Ghostwriting
• Writing and content development
• Editing and proofreading
• Book formatting
• Book cover design
• Illustration
• Publishing assistance
• Distribution assistance
• Author website development
• Author branding
• Book marketing
• Audiobook services
• Printing and related production services
• Other publishing and creative services described in an applicable proposal, package, invoice, or service agreement

The services provided for each project will depend on the scope agreed between Heritage Crest publishing and the client.

Your proposal, quotation, invoice, package, or written service agreement may contain additional terms that apply specifically to your project.

2. PROJECT CONSULTATION AND SCOPE

Before beginning a Project, we may consult with you to understand your requirements, objectives, manuscript, publishing needs, and the Services you wish to receive.

Following this consultation, the Project will proceed according to the agreed:

• Scope of work
• Specifications
• Timeline
• Price
• Deliverables
• Revision terms
• Other applicable Project requirements

The Client is responsible for providing accurate instructions, materials, approvals, and feedback reasonably required to complete the Project.

If you request work that falls outside the original scope, we may provide a revised quotation or charge an additional fee before beginning the additional work.

Changes to the scope may also affect the expected delivery schedule.

3. PAYMENT TERMS

Payment requirements will be communicated through the applicable proposal, quotation, invoice, package, or service agreement.

Depending on the nature of the Project, we may require:

• Full payment in advance;
• An initial deposit followed by milestone payments; or
• Another payment arrangement agreed to in writing.

All payments are due according to the agreed payment schedule.

If an agreed payment becomes overdue, Heritage Crest Publishing may pause or suspend work until the outstanding amount has been received.

Unless otherwise agreed in writing or prohibited by applicable law, final deliverables and the transfer of applicable intellectual-property rights may be withheld until all amounts relating to the applicable Project have been paid in full.

Acceptance of a partial payment does not waive our right to collect any remaining balance that is validly due.

4. COPYRIGHT AND OWNERSHIP

Our aim is to provide clients with appropriate ownership rights in final custom work created specifically for their projects.

Unless otherwise stated in a written agreement, and subject to any third-party licenses or materials, ownership rights in final custom deliverables created specifically for the Client will transfer to the client after full payment of all amounts due for those deliverables.

Once the applicable rights have transferred, the client may use the final custom deliverables in accordance with the applicable agreement and any third-party licensing restrictions.

Heritage Crest Publishing retains ownership of its pre-existing materials, internal processes, tools, templates, methodologies, working materials, unused concepts, proprietary resources, and other materials that are not expressly transferred to the client.

Stock photographs, licensed fonts, third-party graphics, software assets, templates, and similar materials remain subject to the licenses and terms of their respective owners.

5. REVISIONS AND APPROVALS

Revision terms vary depending on the service or package purchased.

Unless otherwise stated in writing, revision requests should be submitted within 14 calendar days of receiving the applicable deliverable.

We may extend this period where exceptional circumstances reasonably require additional time.

Revision requests should remain within the original Project scope.

Requests involving substantial changes to previously approved concepts, manuscripts, instructions, specifications, or deliverables may be treated as additional work and may involve additional charges.

Revision Turnaround

Estimated revision timelines may vary depending on the nature and complexity of the requested changes.

Where a specific revision priority has been agreed:

• Urgent Projects: approximately 24 hours
• Standard Priority Projects: approximately 48 hours
• Larger or More Complex Revisions: approximately 72 hours or longer

These timeframes are estimates unless a particular turnaround has been expressly guaranteed in writing.

6. CLIENT REVIEW AND FINAL APPROVAL

Clients are responsible for carefully reviewing their work before providing final approval.

Depending on the Project, this may include reviewing:

• Manuscripts
• Editing
• Formatting
• Book covers
• Illustrations
• Author websites
• Metadata
• Book descriptions
• Author names
• ISBN information
• Pricing
• Publishing information
• Marketing materials
• Other final deliverables

Approval provided by email, text message, project communication, electronic communication, or another reasonably verifiable written method may be treated as authorization to proceed.

Once final approval has been provided, subsequent changes may be considered additional work and may result in additional charges.

We encourage Clients to carefully review all names, dates, facts, specifications, publishing information, pricing, and other important details before approving final materials.

7. REFUNDS AND CANCELLATIONS

Because our services involve professional time, creative work, writing, editing, design, research, project management, and other resources, refund eligibility depends on the stage and nature of the Project.

Before Work Begins

If you request cancellation before substantive work has begun, you may be eligible for a refund of amounts paid for services that have not yet been performed.

A 15% processing fee may be deducted from the refundable amount, together with applicable third-party costs or expenses already incurred, to the extent permitted by applicable law.

After Work Has Begun

Once substantive work has commenced, amounts attributable to work already performed, professional time incurred, completed milestones, third-party expenses, or resources committed to the Project are generally non-refundable.

Any eligible refund will normally relate only to the portion of the Services that has not yet been performed.

After Final Approval

Once the Client has provided final approval of the applicable work, amounts paid for approved and completed work are generally non-refundable.

Quality Concerns

If you are dissatisfied with a deliverable, please contact us promptly.

Where a legitimate quality issue can reasonably be corrected within the agreed Project scope, we may first provide appropriate revisions or corrections.

Nothing in these Terms limits any consumer rights that cannot lawfully be excluded or waived.

8. CLIENT RESPONSIBILITIES AND MATERIALS

The client shall furnish materials, instructions, information, approvals and feedback to facilitate the timely completion of the project.

The client represents that it has the rights, permissions, licenses or authority to submit any manuscript, photograph, illustration, trademark, quotation, artwork or other material to Heritage Crest Publishing.

You agree that you will not knowingly submit material that infringes another's copyright, trademark, privacy, publicity or other legal rights.

To the extent permitted by applicable law, the client shall defend, indemnify, and hold harmless the company from and against any third-party claims arising from the unlawful or unauthorized materials provided by the client.

Delays in receipt of necessary materials, feedback, approvals or information from the client may affect the project timeline.

9. PUBLISHING AND COMMERCIAL RESULTS

Heritage Crest Publishing provides professional publishing and author-support services. However, publishing and marketing outcomes depend on numerous factors outside our control.

Accordingly, we do not guarantee:

• A specific number of book sales
• Bestseller status
• Specific royalty amounts
• Rankings
• Reviews
• Media coverage
• Profitability
• Advertising performance
• Return on advertising spend
• Search-engine rankings
• Publishing-platform acceptance
• Distribution availability
• Any particular commercial or financial outcome

Our role is to provide the agreed professional services. The commercial performance of a published work may depend on factors including market conditions, reader demand, competition, platform policies, pricing, reviews, marketing performance, and other circumstances beyond our control.

10. THIRD-PARTY PLATFORMS AND SERVICES

Heritage Crest Publishing may assist clients with publishing, distribution, marketing, advertising, printing, or other services through independent third-party platforms and providers.

These third parties operate independently and may maintain their own:

• Terms and conditions
• Privacy policies
• Technical requirements
• Approval processes
• Pricing
• Distribution systems
• Account requirements
• Content policies
• Service standards

Heritage Crest Publishing cannot control decisions or actions taken independently by these third parties.

References to platforms or companies such as Amazon KDP, Apple Books, Barnes & Noble, Kobo, Google Books, or other third parties do not imply sponsorship, partnership, affiliation, or endorsement unless expressly stated.

11. WEBSITE TERMS OF USE

The information available on the Heritage Crest Publishing website is provided for general informational and commercial purposes.

We make reasonable efforts to keep website information accurate and up to date. However, we do not guarantee that all website content will always be complete, current, accurate, or free from errors or omissions.

We may update, modify, replace, suspend, or discontinue website content, features, or services at any time where appropriate.

12. EMAIL AND SMS COMMUNICATIONS

Where you provide your contact information or appropriately subscribe to our communications, Heritage Crest Publishing may contact you regarding your inquiries, Projects, Services, and other relevant matters.

15. INDEMNIFICATION

To the extent permitted by applicable law, the Client agrees to indemnify and hold Heritage Crest Publishing harmless from third-party claims, losses, damages, liabilities, and reasonable expenses arising from:

• Unlawful materials supplied by the Client
• Infringement of third-party rights resulting from Client-supplied materials
• The Client's knowing violation of applicable law
• Unauthorized use of Deliverables by the Client
• A material breach of these Terms by the Client

This provision applies to the extent that the relevant claim, loss, or expense results from the Client's acts, omissions, or breach of these Terms.

16. INDEPENDENT BUSINESS RELATIONSHIP

These terms do not create a partnership, joint venture, employment relationship, franchise, or agency relationship between the Client and Heritage Crest Publishing.

The purchase of our services does not give either party authority to act as the legal representative of the other unless expressly agreed in writing.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These terms are governed by the laws of the State of Colorado, United States, except where applicable federal law or mandatory consumer-protection law provides otherwise.

If a disagreement arises concerning our services or these terms, the parties should first make a good-faith effort to resolve the matter directly.
